Fifteen AGs Filed Statement of Issues in Case against EPA for Failure to Strengthen Ozone NAAQs

New York Attorney General Letitia James led a coalition of 15 attorneys general, along with the City of New York, in filing a statement of issues in their challenge to the Environmental Protection Agency’s (EPA) decision not to strengthen its Ozone National Ambient Air Quality Standards. The statement of issues, filed in the U.S. Court of Appeals for the District of Columbia Circuit, listed the issues the coalition intends to raise in its case against EPA, including whether EPA violated the law by completing an inadequate review of the primary and secondary national ambient air quality standards (NAAQS) for ground-level ozone and subsequently deciding not to strengthen the standards.
