State Impact Center Launches New Health & Environmental Settlements Project

New initiative will review settlement structures used to resolve major health and environmental liability claims

Wash­ing­ton, D.C.—The State Ener­gy & Envi­ron­men­tal Impact Cen­ter at NYU School of Law (State Impact Cen­ter) announced today the launch of a new Health & Envi­ron­men­tal Set­tle­ments Project (Set­tle­ments Project). The State Impact Center’s Set­tle­ments Project will engage out­side experts to pro­vide a ret­ro­spec­tive review of judi­cial and leg­isla­tive set­tle­ment struc­tures that have been uti­lized to resolve major health and envi­ron­men­tal dam­age claims asso­ci­at­ed with tobac­co, oil spills, and tox­ic dis­pos­al sites, among others. 

The Project’s final report will pro­vide a com­pre­hen­sive, inde­pen­dent resource that all par­ties look­ing to learn from past res­o­lu­tions of dif­fi­cult health and envi­ron­men­tal lia­bil­i­ty dis­putes can consult.

The Set­tle­ments Project will pro­ceed in two phas­es, includ­ing an ini­tial Con­ven­ing of Experts to take place in March 2019 at the NYU School of Law, and the prepa­ra­tion of a final report tar­get­ed for release in late 2019 or ear­ly 2020. The State Impact Cen­ter encour­ages qual­i­fied experts to sub­mit an expres­sion of inter­est in par­tic­i­pat­ing in the project by Decem­ber 14, 2018.
