State Attorneys General to Fight Repeal of Clean Power Plan

David J. Hayes released a statement after EPA Administrator Scott Pruitt said he would sign a proposed rule to repeal the Clean Power Plan

WASHINGTON, D.C. — David J. Hayes, executive director of the State Energy & Environmental Impact Center at NYU School of Law (State Impact Center), released the following statement after EPA Administrator Scott Pruitt said he would sign a proposed rule to repeal the Clean Power Plan:

“EPA’s forthcoming announcement is a cynical attempt to indefinitely delay any action to control carbon pollution for U.S. coal plants. Further, the Clean Power Plan cannot be legally nullified now, on the promise that someday, just maybe, EPA will come up with its replacement.

“Fortunately, state attorneys general have vowed to fight efforts to kill the Clean Power Plan. They have already made clear to Administrator Pruitt that the Clean Power Plan’s compliance obligations cannot be swept aside by the Administrator’s pen, particularly by this Administrator, who had promised to recuse himself from Clean Power Plan litigation. State attorneys general understand that protecting the safety of our water and air is more important than doing the bidding of the oil and gas industry.”
