Virginia AG Affirmed Environmental Justice Policy

Virginia Attorney General Mark Herring issued an opinion in response to a question of law posed by a state senator who helped pass Virginia’s Environmental Justice Act (EJA). The senator asked if the EJA must be considered by the Department of Environmental Quality when approving or denying permits for landfills. In response, AG Herring explained that all state agencies, including the Department of Environmental Quality, must include the EJA in their deliberations for permitting any type of project or policy, including landfills.
