Thirty-One AGs Urged FERC to Respect States’ Jurisdiction Over Net Metering

Massachusetts Attorney General Maura Healey led a bipartisan coalition of 31 attorneys general in sending a letter urging the Federal Energy Regulatory Commission (FERC) to deny a petition that requested the commission assert federal jurisdiction over net metering. If approved, the petition would upend existing state-based net metering programs and dramatically slow the growth of rooftop solar and other kinds of distributed electricity generation. In their letter, the attorneys general noted that state leadership has helped make net metering a “cornerstone retail energy policy across the country,” and emphasized that states “should remain the sole decision-making authorities for any further consideration of state net metering policy in the future, consistent with the law.”
