Seventeen AGs AGs Pushed for More Thorough Reviews of GHG Impacts under NEPA
APRIL 10, 2023
New York Attorney General Letitia James and Washington Attorney General Bob Ferguson led 17 attorneys general in filing comments on the Council on Environmental Quality’s (CEQ) interim guidance on how greenhouse gas emissions should be considered under the National Environmental Policy Act (NEPA). The AGs urged CEQ to clarify when projects are legally required to be reviewed under NEPA, and to better coordinate with similar plans at the state, Tribal, and local level. The AGs also argued that in order to better address the impacts of greenhouse gas emissions on environmental justice communities, the guidance should “prioritize the voices of overburdened communities and place them at the center of these analyses.”
