Seven AGs Filed Amicus Brief in Support of Illinois Zero Emission Credit Program
NOVEMBER 3, 2017
A coalition of seven attorneys general filed an amicus brief in support of the State of Illinois’s zero emission credit (ZEC) program, which compensates qualifying nuclear generators for the zero carbon emissions attributes of their energy generation. They argued that the program is squarely within state authority under the cooperative federalism scheme in federal energy law. The attorneys general also noted their strong interest in defending state authority to implement clean energy programs.
