New York AG’s Office Testified at Public Hearing on EPA’s Power Plant Rule

Staff from the office of New York Attorney General Letitia James testified at the Environmental Protection Agency’s (EPA) public hearing on its 2023 proposed rule to set standards for greenhouse gas emissions from existing fossil fuel-fired power plants. In the testimony, Michael J. Myers (Senior Counsel for Air Pollution and Climate Change Litigation in the Environmental Protection Bureau of the New York State Attorney General’s Office) explained that “EPA’s proposed rule represents an important step in the right direction,” explaining that there is adequate demonstration for the need of the rule, and that the rule is consistent with Supreme Court precedent and also provides for state flexibility.
