New York AG and New Jersey AG Filed Petition for Review of EPA’s Denial of Clean Air Act Good Neighbor Petition

New York Attorney General Letitia James and New Jersey Attorney General Gurbir Grewal filed a petition for review of the EPA’s denial of New York’s 2018 petition under the “good neighbor” provision of the Clean Air Act. The petition asked the EPA to find that power plants in nine states were interfering with New York’s attainment with National Ambient Air Quality Standards for ozone. The Clean Air Act’s “good neighbor” provision requires that the EPA impose restrictions on power plants and other pollution sources in upwind states that are creating unhealthy conditions in downwind states.
