New York AG and New Jersey AG Filed Motion to Intervene in Litigation Over EPA’s Refusal to Regulate Upwind Sources of Air Pollution

New York Attorney General Barbara Underwood and New Jersey Attorney General Gurbir Grewal filed a motion to intervene in ongoing litigation brought by Delaware Attorney General Matthew Denn and Maryland Attorney General Brian Frosh over the Environmental Protection Agency’s (EPA) refusal to regulate air pollution from upwind states. The litigation came in response to the EPA’s October 2018 denial of four petitions brought by Delaware and one petition brought by Maryland seeking additional controls on sources of air pollution in neighboring states that impair the states’ ability to attain compliance with 2008 and 2015 National Ambient Air Quality Standards.
