New Jersey AG Announced Eight New Environmental Enforcement Actions

New Jersey Attorney General Matthew J. Platkin, along with the Commissioner of the Department of Environmental Protection, announced eight environmental enforcement actions—including five actions to address toxic pollutants in communities that are classified as overburdened under the state’s Environmental Justice law—and two settlements resolving earlier lawsuits of a similar nature. The environmental justice actions included a directive against Canrad Hanovia to clean up soil and groundwater contamination; a lawsuit against Fort Lee Tire Center for contaminating soil with gasoline; a lawsuit against MJ & Sons for illegally transporting and storing solid waste; a lawsuit against SB Milltown for discharging oil containing polychlorinated biphenyls; and a lawsuit against International Customer Corp for contaminating soil and groundwater with arsenic, tetrachloroethene, lead, and nickel. Three additional remediation and cost recovery actions were also announced. The enforcement actions and lawsuits seek court orders to clean up contamination and payments to the state including both civil penalties and costs, among other requirements.
