New Hampshire AG Filed Lawsuits against Manufacturers and Sellers of PFAS Products

New Hampshire Attorney General Gordon MacDonald filed a lawsuit against eight chemical companies over per- and polyfluoralkyl substance (PFAS) contamination resulting from the manufacture and sale of firefighting foam, and an additional lawsuit against DuPont, Chemours and 3M over the manufacture and sale of other products containing PFAS. In the lawsuits, AG MacDonald alleged that the companies continued to manufacture and sell products containing PFAS despite being aware of the persistent and bioaccumulative nature of the chemicals. The lawsuits sought repayment for the costs of remediation, as well as “enhanced compensatory damages” on the grounds that the companies’ actions were “committed intentionally, wantonly, maliciously and/or oppressively.”
