Michigan AG Successfully Supported Traverse City Infrastructure Updates to Prevent Flooding and Invasive Species

Michigan Attorney General Dana Nessel filed an amicus brief supporting Traverse City’s plans to update a local dam in order to prevent flooding and protect local bodies of water from invasive species. A circuit court judge enjoined the city from carrying out the updates, ruling that the city’s charter requires the city to hold a vote on the issue before it can proceed. In her brief, AG Nessel supported the city’s claims that a vote is not required.

On October 27, 2022, AG Nessel announced that the Michigan Court of Appeals reversed that order, allowing the project to proceed.
