Michigan AG Successfully Supported Traverse City Infrastructure Updates to Prevent Flooding and Invasive Species

In September 2022, Michigan Attorney General Dana Nessel filed an amicus brief supporting Traverse City’s plans to update a local dam in order to prevent flooding and protect local bodies of water from invasive species. A circuit court judge enjoined the city from carrying out the updates, ruling that the city’s charter requires the city to hold a vote on the issue before it can proceed. In her brief, AG Nessel supported the city’s claims that a vote is not required.

In October 2022, AG Nessel announced that the Michigan Court of Appeals reversed that order, allowing the project to proceed.
