Illinois AG Filed Lawsuit against Salvage Yard for Illegal Air and Water Pollution following Fire
APRIL 24, 2023
Illinois Attorney General Kwame Raoul filed a lawsuit against Mowery Auto Parts, an auto salvage yard, and its owner over a fire that took place on the property in January 2023 that resulted in “a substantial danger to the environment and public health, air and water pollution, unpermitted open dumping of waste and open burning of used or waste tires.” The fire burned about 300 used tires, in addition to vehicles, tire machines, and bailers, all of which emitted particulate matter and other contaminants into the air, and resulted in hazardous runoff into groundwater and the nearby Pecatonica River. AG Raoul’s office also filed an agreed immediate preliminary injunction, requiring the defendants to clean up the contaminants from the fire, and take preventative action against future pollution.
