Fourteen AGs Filed Amicus Brief Urging Court to Keep Michigan’s Line 5 Pipeline Case against Enbridge in State Court

Minnesota Attorney General Keith Ellison led a coalition of 14 attorneys general in filing an amicus brief supporting Michigan’s efforts to move its lawsuit against Enbridge back to state court. Michigan’s lawsuit seeks to shut down Enbridge’s Line 5 pipeline, which passes beneath the Straits of Mackinac and poses a serious spill risk to the Great Lakes region. In their brief, the AGs argued that the case should be heard in state court because there is no federal issue at hand that is “substantial enough to deprive the state its sovereignty to hear state-law claims regarding state property brought by a state official in state court.”
