Fourteen AGs Filed Amicus Brief in Support of California’s Right to Coordinate with Quebec on Cap-and-Trade

Oregon Attorney General Ellen Rosenblum led a coalition of 14 attorneys general in filing an amicus brief in support of California’s right to coordinate its cap-and-trade program with a similar program in the Canadian province of Quebec. In their brief, the AGs countered the administration’s claim that the agreement interferes with federal prerogatives, and highlighted the fact that the administration has not challenged other agreements that share the features it has deemed objectionable in this particular case. The AGs noted that states “have routinely entered into interjurisdictional agreements akin to the one at issue in this case to coordinate solutions to problems that transcend jurisdictional boundaries,” and that agreements between states and foreign governments “number[] in the hundreds or thousands.”
