Fifteen AGs Filed Petition for Review of EPA’s Risk Evaluation of 1,4-Dioxane

New York Attorney General Letitia James led a coalition of 15 attorneys general filing a petition for review of the Environmental Protection Agency’s (EPA) flawed Toxic Substances Control Act risk evaluation for 1,4-dioxane, a widely used solvent that is recognized by the EPA as a likely human carcinogen AGs had previously submitted comments in December 2020 raising concerns that the EPA’s draft evaluation failed to analyze risks to high-exposure subpopulations, excluded numerous exposure pathways and improperly assumed universal use of personal protective equipment, among other deficiencies. The AGs also questioned the EPA’s unexpected decision to expand the scope of the evaluation to include a number of consumer applications of 1,4-dioxane — a decision apparently made at the request of cleaning product industry groups seeking to preempt state regulations.
