Eleven AGs Supported Rulemaking to Protect Migratory Birds

New York Attorney General Letitia James led a coalition of 11 state attorneys general in submitting comments in response to the Department of the Interior’s (DOI) advanced notice of proposed rulemaking to protect migratory birds. DOI is exploring creating defined conditions and regulatory certainty around incidental take (unintentional harm caused to migratory birds as a result of a project or activity). The AGs provided eight recommendations in the letter, including that DOI work with state and regional wildlife agencies in the development of a rule and that the agency develop general permit authorizations only for activities that have comprehensive and well-established practices to prevent harm to birds.
