Eleven AGs Filed Amicus Brief in Litigation Over EPA Federal Advisory Committees

Washington Attorney General Bob Ferguson led a coalition of 11 attorneys general in filing an amicus brief with the U.S. Court of Appeals for the D.C. Circuit in Physicians for Social Responsibility v. Wheeler in support of plaintiffs challenging a directive by the EPA prohibiting scientists who receive EPA grant money from serving on any EPA advisory committee. In the amicus brief, the attorneys general asserted that the directive is not only unlawful, but also “dangerous to human health and the environment.” The directive hampers the EPA’s ability to conduct “rigorous science” and prevents the EPA from carrying out its central mission — “all to the detriment of states, regulated entities, and the American people.”
