Delaware AG Submitted Petition for Review of EPA’s Refusal to Regulate Upwind Sources of Air Pollution

Delaware Attorney General Matthew Denn submitted a petition for review of the Environmental Protection Agency’s (EPA) decision to deny four petitions submitted by the state seeking additional regulations on sources of air pollution in neighboring states. In its petitions, Delaware requested that EPA find that emissions from neighboring states were contributing to Delaware’s nonattainment with 2015 National Ambient Air Quality Standards for ozone. The EPA denied Delaware’s petitions, as well as a separate petition filed by Maryland, in October 2018.
