Delaware AG Reached Settlement with DuPont, Chemours, Others over PFAS Contamination

In July 2021, Delaware Attorney General Kathy Jennings reached a settlement with a group of companies—including DuPont and Chemours—over their role in contaminating the state’s natural resources with per- and polyfluoroalkyl substances (PFAS), also known as “forever chemicals” for their resistance to breaking down in the human body or the environment. Under the settlement agreement, the companies were required to pay $50 million for “environmental restoration, improvement, sampling and analysis, community environmental justice and equity grants, and other natural resource needs.” Additionally, the settlement agreement

In November 2023, the AG announced that that state of Ohio reached a similar settlement with the companies, triggering the contingency in Delaware’s settlement agreement that required an additional $25 million to be paid to Delaware. “We are thrilled that our forward-thinking settlement with Dupont and others is now $25 million more valuable to the State of Delaware. That’s 50% more to restore our nature resources, to support public health initiatives in impacted communities, and to keep our neighbors healthy,” said AG Jennings in a statement to the press.
