Connecticut AG and New Jersey AG Filed Lawsuit Over EPA’s Inaction on Ozone Pollution

New Jersey Attorney General Gurbir Grewal and Connecticut Attorney General William Tong filed a lawsuit seeking to compel the EPA to fulfill its “good neighbor” obligations under the Clean Air Act by forcing upwind states to address nitrogen oxide pollution that is contributing to smog in New Jersey and Connecticut. The lawsuit seeks to force the EPA to make an overdue finding that two states — Pennsylvania and Virginia — that significantly contribute to ozone pollution in New Jersey and Connecticut have failed to submit Clean Air Act compliant plans. This finding would then trigger the EPA to implement its own plan to reduce nitrogen oxide emissions from those states that are contributing to NJ and CT’s ozone nonattainment.
