California AG Sent Comments Raising Legal Issues with Warehouse Development Plan

California Attorney General Rob Bonta filed comments with the Inland Valley Development Agency and the Cities of Highland and San Bernardino regarding a proposed warehouse development plan titled the Airport Gateway Specific Plan. According to AG Bonta’s comments, the plan would “initiate displacement of approximately 2,600 residents of a socioeconomically disadvantaged and environmentally overburdened majority-Hispanic community” and would worsen pollution of an already overburdened area by increasing heavy-duty diesel truck traffic by over 3,000 trips a day. The comments raised several legal issues with the plan, including violation of the Housing Crisis Act of 2019, and offered a number of “feasible and less discriminatory alternatives.”
