California AG Issued Legal Advisory on Migratory Bird Treaty Act and California Law

California Attorney General Xavier Becerra and the California Department of Fish and Wildlife jointly released a legal advisory affirming that protections for migratory birds under California state law remain in place. The state’s advisory responds to a controversial solicitor’s opinion issued by Interior Department Acting Solicitor Daniel Jorjani overturning decades of regulatory precedent on the U.S. Fish and Wildlife Service’s ability to hold companies accountable under the Migratory Bird Treaty Act for the predictable harm that their operations have on birds, even if that harm is unintentional.
