Twenty-Four AGs Opposed Certiorari at Supreme Court in EPA Power Plant Emissions Case

New York Attorney General Letitia James led a coalition of 24 states and seven cities in opposing certiorari at the Supreme Court in a case about the Trump-era rollback of the Environmental Protection Agency’s (EPA) greenhouse gas limits for power plants. The rule, known as the Affordable Clean Energy rule, was vacated by the U.S. Court of Appeals for the D.C. Circuit. A separate group of states asked the Supreme Court to review the D.C. Circuit ruling. Given that EPA was still reconsidering how to regulate these emissions from power plants at the time the coalition opposed cert, the question in the case was whether it was the right time for the Supreme Court to weigh in.
