North Carolina AG Filed Lawsuit Against DuPont, Chemours and Related Companies Over PFAS Contamination

North Carolina Attorney General Josh Stein filed a lawsuit against DuPont, Chemours, and related companies over their role in contaminating the state’s waterways and other natural resources with per- and polyfluoroalkyl substances (PFAS). The lawsuit centered on the companies’ Fayetteville Works facility, which has been identified as the source of significant PFAS contamination afflicting the immediate surrounding area and the greater Cape Fear River watershed. The complaint emphasized that the companies “have knowingly discharged vast quantities of PFAS into the air, water, sediments, and soils of Cumberland County and southeastern North Carolina,” and that those discharges “have had and continue to have profoundly negative impacts on the State.”
In November 2022, the Supreme Court of North Carolina affirmed that the Business Court has personal jurisdiction over Corteva and New Dupont and remanded the case to the Business Court.
