Nineteen AGs Called for Stronger NEPA Protections

California Attorney General Rob Bonta, New York Attorney General Letitia James, and Washington Attorney General Bob Ferguson led a coalition of 19 attorneys general in sending a comment letter in response to the Council on Environmental Quality’s proposed rule to revise regulations implementing the National Environmental Policy Act (NEPA). The comment letter argued that rolling back parts of the 2020 rule was an improvement, but that the new changes are not nearly strong enough. The coalition argued that the Biden Administration must continue to further revise the 2020-era NEPA provisions or repeal them entirely and make sure that the following proposed rules keep environmental justice principles in mind, consider state and tribal policies, and ensure diverse participation in hearings.
