Fourteen AGs Submitted Comments Urging EPA to Regulate Persistent, Bioaccumulative, and Toxic Chemicals to Fullest Extent
MAY 17, 2021
New York Attorney General Letitia James led a coalition of 14 attorneys general in submitting comments asking the Environmental Protection Agency (EPA) to use its full authority under the Toxic Substances Control Act (TSCA) to regulate certain persistent, bioaccumulative, and toxic (PBT) chemicals, which pose a threat to the environment and to human health. Following a number of executive orders from the Biden administration, EPA proposed a new rule relating to five specific PBT chemicals. In their comments on the rule, the AGs urged EPA to broaden its interpretation of language in TSCA to allow for greater PBT reduction, to regulate occupational exposures to and the disposal of PBT chemicals, and to be stricter about granting exemptions.
