Fifteen AGs Challenged NHTSA’s Delay of Inflation Adjustments of Fines for Non-Compliance With Vehicle Efficiency Standards

New York Attorney General Letitia James led a coalition of 15 attorneys general in filing a petition for review of the National Highway Traffic Safety Administration’s (NHTSA) attempt to delay statutorily mandated inflation adjustments of penalties for automakers whose vehicle fleets fail to meet federal fuel efficiency standards. The petition challenged a last-minute interim final rule issued by the outgoing Trump administration in mid-January 2021 that sought to delay the effectiveness of the inflation adjustments to model year 2022.
