Connecticut AG Submitted Comments Supporting FERC Proposal to Limit Transmission Incentives

Connecticut Attorney General William Tong submitted comments to the Federal Energy Regulatory Commission (FERC) affirming the agency’s authority to limit transmission incentives. In a March 25, 2020 notice of proposed rulemaking (NOPR) and a Supplemental NOPR on April 15, 2021, FERC proposed a limit on the duration of an incentive for participation by a transmission owner in a Regional Transmission Organization to three years. The New England Transmission Owners (NETOs) filed comments opposing the proposal and alleging that FERC does not have the authority to limit incentives. In his comments, AG Tong disputed each of NETOs arguments, asserting that FERC does have the authority to limit and terminate incentive durations.
